Terms and Conditions for Fenner Contracting

These Terms and Conditions ("Terms") govern the use of the website and services provided by Fenner Contracting LLC ("Contractor," "we," "our," "us"). By accessing or using our website or engaging our services, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree with these Terms, please do not use the website or services.
1. SERVICES PROVIDED
Fenner Contracting LLC provides concrete installation, hardscaping, grading, demolition, and other related services. These services will be outlined in the specific Service Agreement or estimate sent to the Client. The details of the services provided, including cost, timeline, and work details, are described in the project-specific Service Agreement.
Scope of Work: All services and terms are detailed in each individual Service Agreement or project estimate, which both the Contractor and Client must review and agree upon before services commence.
2. PAYMENT TERMS
General Payment: Payment terms for all services provided are outlined in the Service Agreement specific to each project. The Client agrees to pay the amounts specified in the Service Agreement.
Accepted Payment Methods: Fenner Contracting accepts payments via check, credit card, and bank transfer. Payment terms and schedules, including deposits and final balances, are set forth in the Service Agreement for each specific project.
Deposit: A deposit may be required prior to starting work, as outlined in the Service Agreement.
3. WARRANTY AND GUARANTEES
Fenner Contracting provides a 1-year warranty on the work performed, covering defects in workmanship and materials.
Limitations:
Cracks: Cracks are a normal part of the aging process in concrete and related materials and will occur over time due to settling, weather, and other natural conditions. These are not covered under the warranty unless they result from a defect in materials or workmanship.
Exclusions: This warranty does not cover:
Defects or damages arising from misuse, neglect, or alterations by the Client.
Normal wear and tear.
Damages caused by external factors beyond the Contractor’s control (e.g., weather, soil movement, etc.).
4. CLIENT RESPONSIBILITIES
Access and Cooperation: The Client agrees to provide Fenner Contracting with access to the worksite and ensure that all necessary utilities and conditions are made available for the project’s successful completion.
Notices: Any special requirements or changes to the scope of work must be provided to Fenner Contracting in a timely manner. Failure to provide adequate notice may result in additional charges or delays.
5. CANCELLATION AND TERMINATION
Cancellation: The Client may cancel the project at any time by providing written notice. If the Client cancels the project after work has commenced, the Client agrees to pay for all services rendered up to the point of cancellation.
Termination: Fenner Contracting reserves the right to terminate the Service Agreement for breach of the agreement by the Client, including failure to make payments as outlined in the agreement. Termination will not release the Client from payment obligations for work already completed.
6. PRIVACY POLICY
Fenner Contracting is committed to safeguarding your personal information. We collect and store personal information such as names, addresses, and contact details to fulfill service agreements and provide customer support.
Data Protection: We will not sell or share your personal data with third parties, except when necessary to provide the service (e.g., subcontractors or suppliers).

7. LIMITATION OF LIABILITY
Fenner Contracting is not liable for any indirect, incidental, or consequential damages arising from or related to the use of our services. Our liability is limited to the total amount paid by the Client for the services rendered, subject to the provisions of the Service Agreement.
No Responsibility for External Factors: Fenner Contracting is not responsible for damages caused by factors beyond our control, including weather conditions, soil instability, or any other unforeseen external events.
8. DISPUTE RESOLUTION AND GOVERNING LAW
Dispute Resolution: In the event of a dispute, both Parties agree to attempt resolution through mediation. If mediation is unsuccessful, the dispute will be resolved through arbitration in accordance with Georgia law.
Governing Law: These Terms and the Service Agreement are governed by and construed in accordance with the laws of the state of Georgia. Any legal action shall be initiated in a court located within the state of Georgia.
9. INTELLECTUAL PROPERTY
All content on Fenner Contracting’s website, including logos, images, text, and videos, are the intellectual property of Fenner Contracting LLC. The use, reproduction, or distribution of these materials without our express permission is prohibited.
10. CHANGES TO TERMS AND CONDITIONS
Fenner Contracting reserves the right to amend these Terms and Conditions at any time. All updates will be posted on our website, and the date of the last revision will be noted at the top of this page. Continued use of our website or services after the changes have been posted constitutes acceptance of the new Terms.
